
Jury Duty/Legal Action Procedure - 63.08.07

Eligibility
All Howard Community College budgeted and temporary employees are entitled to paid leave when summoned to appear for jury duty during a scheduled shift or working hours. Paid leave is also provided when any budgeted or temporary employee is summoned or subpoenaed to appear during a scheduled shift in a court action, before a grand jury, before an administrative agency, or for a deposition, provided that the employee is neither a party to the action nor a paid witness.
Approval Process and Other Information
Employees are expected to provide their supervisors with the official written summons or subpoena so arrangements can be made for work coverage during the absence. If possible, proof of attendance must also be provided afterwards. A Request For Leave must accompany the documentation when required by the supervisor.
When the jury or legal commitment does not consume the employee’s entire scheduled work shift or working hours, the employee is expected to fulfill the remainder of the shift and hours to the extent possible. In accordance with state law, the employee is not expected to reimburse the college for nominal expense money received from the court system for participation in jury duty or a legal action, such as for parking or meals.
Employees may not receive both college salary and an additional wage or salary for participating in jury duty or a legal action. An employee who chooses to maintain college salary under this procedure while on jury duty or a legal action must pay to the college any wage or salary received for the jury or legal appearance.
Accrual of Leave and Automatic Leave Sequence
Leave for jury duty or legal actions is not accrued and is granted only when such leave is required. Individuals accrue annual and sick leave while on this type of leave. There is no automatic leave sequence for this type of leave.
