Use of Copyrighted Works Policy - 40.03

College Procedure Number/Title:

Copyright Law of the United States protects authors and their published and unpublished works from unauthorized reproduction and sale of their works. Examples of copyright protected works include, but are not limited to: literary works; poetry and novels; dramatic works, such as movies and plays; musical works, such as songs; artistic works, such as drawings or pictorial, graphic, and sculptural works; computer programs; sound recordings; and audiovisual works. The copyright law also addresses how works may be used in an educational setting.

Howard Community College complies with the Copyright Act of 1976 including the “Fair Use Doctrine” [17 USC Section 106 and 107 et seq.], the Digital Millennium Copyright Act (DMCA) of 1998 [112 Stat. 2860], and the Technology, Education, and Copyright Harmonization (TEACH) Act of 2002 [17 USC Section 110 (2)] in the college’s use of copyrighted works. The college’s policy, procedure, and institutional processes inform members of the college community on compliance practices.

Questions regarding the use of copyrighted work must be resolved before the work becomes part of college instructional resources and activities. Individual faculty or staff members are responsible for obtaining permission to duplicate, present, or perform any copyrighted materials.
