Intellectual Property Rights for Commissioned Artistic Work Procedure - 40.02.03
College Policy Number/Title:
Howard Community College (HCC) recognizes the intellectual property that exists in an artist’s commissioned work. All commissioned work, whether for payment or free, will be documented in a written agreement between the college and the artist, who may be an employee or an outside individual.
Agreements for commissioned work will express the understanding between the parties for the retention of the work, reproduction rights, and any future use by the college. Generally, the artist will retain copyright to the intellectual property, will allow the college to retain the work, and will receive authorship credit for any reproductions of the work. The agreement will also include any permissions granted for alteration or substitutions for the artistic product, permissions and provisions regarding use of the work for promotional and public relations purposes, as well as any additional use or licensing that has been agreed to by both parties.
