Notice of Penalties for Drug Violations


This notice provides information on the penalties associated with drug-related offenses under section 484(r) of the Higher Education Act.  Howard Community College will provide a timely notice to each student who has lost eligibility for any grant, loan, or work-study assistance as a result of penalties under 484(r) (1) of the HEA.

SUSPENSION OF ELIGIBILITY FOR DRUG-RELATED OFFENSES 
 
In general, a student who has been convicted of any offense under any Federal or State law involving the possession or sale of a controlled substance during a period of enrollment for which the student was receiving Title IV aid shall not be eligible to receive any Title IV grant, loan, or work assistance during the period beginning on the date of such conviction and ending after the interval specified in the following table: 


Possession of an Illegal Substance

2 years from date of conviction

Third Offense

Indefinite period of time


Sale of an Illegal Substance


Ineligiblity Period

First Offense

2 years from date of conviction

Second Offense

Convictions only count if they were for an offense that occurred during a period of enrollment for which the student was receiving Title IV aid. Convictions do not count if the offense was not during such a period. Also, a conviction that was reversed, set aside, or removed from the student’s record does not count, nor does one received when the student was a juvenile, unless the student was tried as an adult.
